Infinite Iris Ltd - Booking & Purchase Terms

These terms apply to all bookings, photography sessions, and product purchases made with Infinite Iris Ltd ("we", "us", "our"), a company registered in England and Wales (Company No. 07304957), whether at our purpose-built private studio in Ashford, Kent, or selected pop-up locations, events and partner venues across Kent and the South East of England.
1. Bookings & Sessions
1.1 Sessions can be booked online or in person, subject to availability.
1.2 A session involves a macro photograph being taken of the client's iris, from which a final edited image is produced for use on the client's chosen product(s).
1.3 We may ask you to arrive at a specific time and reserve the right to reschedule or shorten a session if you arrive significantly late.
1.4 Location availability (our purpose-built private studio in Ashford, Kent, and selected pop-up locations, events and partner venues across Kent and the South East of England) is subject to change and confirmed at time of booking.
2. Payment
2.1 We accept card payments only, either online at time of booking/purchase or in person via card terminal.
2.2 Once you have viewed your proof and approved your final edited image (see Section 4), full payment for your chosen product(s) is due in full before production can begin.
2.3 Prices are as displayed at the time of booking/purchase and are subject to change, though confirmed bookings will honour the price agreed at booking.
3. Image Rights, Consent & Use
3.1 By booking a session, you consent to us photographing your iris and processing the resulting image to produce your chosen product.
3.2 Infinite Iris Ltd retains copyright and ownership of the original and edited photographic image. Purchasing a product grants you a licence to own and display that specific physical product; it does not transfer copyright or grant rights to reproduce, resell, or use the image commercially.
3.3 We will ask separately whether you consent to your (anonymised or otherwise) image being used in our portfolio, website, or marketing materials. You may decline this and still proceed with your booking, and you may withdraw this consent at any time by contacting us.
3.4 Where the client is under 18, a parent or legal guardian must provide consent and be present at the session.
3.5 Children should be able to comfortably hold their eye still for several seconds. We reserve the right to advise that very young children are not yet suitable for iris photography.
3.6 Customers may not alter, reproduce or commercially exploit our artwork without written permission. Customers are welcome to photograph and share their purchased artwork on social media for personal, non-commercial purposes.
4. Proofing & Approval
4.1 You will be shown a proof or preview of your edited image before final production begins.
4.2 Once you approve the final image, full payment is required before production begins (see Section 2). After payment is received and production has commenced, we are unable to offer changes, refunds, or cancellation on your bespoke item (see Section 5).
4.3 Whilst we make every effort to capture a high-quality iris image, in rare circumstances this may not be possible due to factors beyond our control, including eye movement, medical conditions, contact lenses or anatomical characteristics. If we are unable to obtain a satisfactory image, no obligation to purchase will arise.
4.4 Soft contact lenses can usually remain in place. However, coloured, cosmetic or patterned lenses must be removed before photography as they obscure the natural iris.
4.5 Colours may vary slightly between digital previews, printed products and different display devices due to differences in colour calibration and printing processes.
4.6 While we carefully enhance and artistically present each image, the unique natural characteristics of your iris remain visible and form part of the artwork.
4.7 Artwork layouts, artistic effects and design styles are individually created by Infinite Iris Ltd. We welcome customer preferences before approval, however the final artwork is subject to customer approval prior to production.
5. Returns, Cancellations & Your Rights
5.1 Our wall art and products are made bespoke to your individual iris image and are therefore personalised goods.
5.2 Under the Consumer Contract Regulations 2013, personalised/bespoke goods are exempt from the standard 14-day right to cancel once production has begun. This does not affect your right to a refund, repair, or replacement if an item is faulty, damaged, or not as described, under the Consumer Rights Act 2015.
5.3 If you wish to cancel a session before it takes place, please give at least 48 hours' notice. As no payment is taken until after image approval, no charge applies for cancellations made before this point; however, we ask for reasonable notice so we can offer the slot to another client.
5.4 Any damage or fault with a finished product should be reported to us within 14 days of collection/delivery.
6. Production & Delivery
6.1 Estimated production and delivery timescales will be confirmed at the time of purchase and may vary by product type and current order volume.
6.2 Where items are collected in person (e.g. at a pop-up or studio visit), we will notify you when your item is ready.
6.3 Risk in the goods passes to the customer upon delivery or collection.
7. Liability & Health and Safety
7.1 We hold appropriate public liability insurance covering our purpose-built studio and any authorised pop-up, event or partner venue from which we operate.
7.2 We are not liable for any indirect or consequential loss. Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud.
7.3 At pop-up and outdoor events, sessions may be affected by weather, venue access, or circumstances beyond our control; we will offer to rebook where a session cannot go ahead.
8. Data Protection
8.1 We process your personal data (including photographic images) in accordance with UK GDPR and the Data Protection Act 2018. Full details are set out in our separate Privacy Policy.
8.2 Images are stored securely and only used for the purposes of producing your product and, where consented to, marketing purposes.
8.3 You can request access to, correction of, or deletion of your personal data at any time by contacting us.
8.4 Any biometric data is not used for identification purposes.
9. General
9.1 These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
9.2 We may update these terms from time to time; the version in effect at the time of your booking will apply.
9.3 If any part of these terms is found unenforceable, the remainder will continue to apply in full.
10. Force Majeure
10.1 We shall not be liable for delays or failure to perform caused by events beyond our reasonable control including severe weather, illness, equipment failure, transport disruption or venue cancellation.
